If Peter Slipper does end up in gaol for defrauding the Commonwealth, the next signings on Tony Abbott’s Battlelines book tour may be from an adjoining cell, writes Dr Benjamin Thomas Jones.

The Australian political version would be: let he without dubious expenses sling the first mud.
If what goes around truly does come around, then Tony Abbott may live to regret his attacks on Peter Slipper.
The former Speaker of the House of Representatives has faced the full wrath of the Liberal Party since choosing to defect in November 2011. Despite being unofficially told that he would not be given pre-selection for his seat of Fisher, the fact that he effectively gave the ALP two extra votes on the floor (the Liberals would lose Slipper’s vote while Labor would gain former Speaker Harry Jenkin’s vote) was seen as an unacceptable betrayal.
Less than four months into the role, Slipper’s former staffer James Ashby accused him of misusing cab charges and of sexually harassing him. The episode became hugely embarrassing as crude text messages became public. With his old friend and former ministerial colleague in the Howard government, Mal Brough, waiting in the wings for Slipper’s seat, Tony Abbott went on the offensive. The presumption of innocence was never afforded to Slipper by the Coalition or the scandal-hungry media.
Abbott claimed Julia Gillard showed bad judgement in appointing Slipper to the Speaker’s chair. The allegation was absurdly hypocritical. Had John Howard also shown bad judgement when he made Slipper his parliamentary secretary in 2002? Had Abbott shown poor judgement when the Liberal Party gave Slipper pre-selection in 2010? The accusations of sexual harassment and cab charge abuse were thrown out as groundless, politically motivated attacks. Australian Federal Police have since accused Slipper of wrongly charging $1,194 to the Commonwealth when visiting local vineyards in Canberra in 2010. He offered to pay this money back but the Department of Finance has broken its own protocol by refusing to allow the money to be refunded.
Slipper’s alleged “crime” is derisory.
Ministers are entitled to compensation for travel, food and accommodation needed when carrying out their duties. The line can be hazy. If two MPs have dinner together at a vineyard is that business or pleasure? What if they are friends and they discuss both government policy and their kids? With MPs having many complex entitlements, it is understandable that some overcharging occurs. To keep things in perspective, over half a million pounds was paid back by British MPs in the wake of the 2009 parliamentary expense scandal. Slipper’s thousand dollars or so seems very minor in comparison.
The leader of the opposition has no sympathy for Slipper and is still questioning his character and presuming his guilt.
“Why did the prime minister ever think that the gentleman in question was fit and proper to be the Speaker of our country?” demanded Abbott on Tuesday.
But if Slipper is not fit and proper to be Speaker then Abbott is definitely not fit and proper to be prime minister.
Tony Abbott released Battlelines in 2009. It was a book designed to set the tone for his leadership and outline his vision for Australia. From his Sydney seat of Warringah, Abbott flew to Canberra to discuss the book at the National Press Club on 28 July. While it can probably be argued that the Press Club visit was legitimate business – even if it was to discuss and sign copies of his book – how would he explain his trip to Melbourne on 3 August for a dinner event at a Dymocks bookstore? Abbott returned to Melbourne as well as visiting Brisbane and Perth to promote his book. In all, he charged $5,689.36 to the Commonwealth for business that seems personal not parliamentary. That was only the air fares. Including drivers to and from his book events, the taxpayer has put $6,651.96 towards the promotion of his book.
Was Abbott conducting parliamentary business? Certainly, that will be his defence.
The Dymocks events in Melbourne and Perth are particularly damning. The timing of the trips strongly suggests that book promotion was the primary purpose. It is possible, of course, that Abbott also conducted legitimate business in between signing copies of Battlelines – just as it is possible Slipper conducted legitimate business in between glasses of Clonakilla winery’s famous shiraz viognier. From the point of view of the tax payer, keeping Slipper boozed up is certainly cheaper than Abbott’s self-promotion.
Common sense would suggest that both cases are murky and that both MPs should be allowed to simply pay the money back.
Common sense, unfortunately, is not the stock in trade of either politicians or the media. If Slipper is found guilty he will be forced to resign from parliament and to forfeit his parliamentary pension of $157 000 per annum. He could also face jail time for his $1,194 oversight.
As a devout Catholic, Abbott would be wise to follow some more advice from Jesus, “judge not lest ye be judged”. If Slipper does end up in the Slammer, the next stop on the Battlelines book tour may be an adjoining cell.
Editor’s note: Abbott is one of Australia’s most expensive politicians. He apparently has a “liberal” attitude towards public expenditure for his own use. For instance, he claimed $345 a day expenses for every day on the 2011 Pollie Pedals ride (1-9 April, 2011) listing it all as ‘Official Business’.

Slipper will not go to jail, or lose his pension or his job. Just because the moron media always say what the highest possible thing could be does not mean it is true.
The court will now throw it out for sure because Slipper offered to pay the money from when he was an MP for the liberal party and the finance department said no over a small amount.
Couts don’t much like having their time wasted on this sort of lunatic trivia and I do get sick of everyone – you included – claiming that consequences that have never before fallen on any MP for anything remotely similar will fall solely on Slipper.
Thanks to Margo and the guy at the AAP and Ashby now claiming leave to appeal a non-case that has already cost taxpayers over $1 million for nothing the media might start asking proper questions instead of joining in the slimey persecution.
Only Brian Burke ever went to prison for entitlement rorts and he was later acquitted of most of it and now after 6 years of being persecuted by the ICC in WA he has been found to be innocent of all and every claim of corruption.
Now Gordon Nuttall is a different kettle of fish, he took hundreds of thousands and deserves prison.
But not even Mal Colston was charged, none of Howards MP’s were charged ever, Nick Sherry was not charged.
So why does every person continue to claim that Slipper faces 5 years jail over $1000 fucking dollars when it is clear he won’t.

To be clear, the article does not say that Slipper will go to jail only that it is a possibility – which from a legal point of view. Is it likely? I don’t think so. The article makes the point that Abbott has a far worse record of dubious claims and it is equally unlikely that he will see jail time. The point of this article is simply to run against the mainstream media trend of demonising Slipper and presuming his guilt. The claims by Ashby have been proven false and this latest charge will probably come to nothing. That leaves us wonder, why has Abbott been given a green light to trash this man’s reputation and try to overthrow the government?

Marilyn S. Those transgressions aren’t listed in law, but the charge and possible consequences for Slipper are.
The jail mention is relevant because if found guilty, no matter what punishment is meted out, the potential length of term is a criterion for his losing his seat. While I agree it seems unlikely, how likely has any of this vicious action seemed? It has gone way beyond what I’d have thought possible in modern Australian politics and still continues to surprise me.

My admittedly limited understanding is that perception of Brough’s obtaining of the diary-extracts might be changed by this alleged finding of wrong-doing. Perhaps someone with legal knowledge can confirm or contradict this. Can it now be argued as action ;in the public interest’?
I thought my respect for Tony Abbott as a politician was as low as it possibly could be. But hearing him call his ‘mate’ of not long ago ‘the gentleman in question’ and say it went to Julia Gillard’s judgement was the absolute last straw. I have no respect for him either as a politician or a person.

$1100 in 23 years would mean years in jail and loss of job and pension? Give me a break.
I agree with MaralynS over these bloody lazy hacks in the MSM who always quote the maximum sentence that only applies when a person is a repeat offender and even in the highly unlikely chance Peter Slipper were found guilty he would not receive a jail sentence, rather a bond due to his absence of a record and lifetime of civic duty: at the very very most this is a case that is quite normal with an MP over-charging.
On top of that, it will be 6-8 months before the case is heard (but I predict as well it will be dropped or thrown out)and even then he would appeal- another 12 months or so.
But this opens an avenue to inspect every other MPs history of over-charging and paying back and as a precedent has now been set we need answers as to why the AFP have partisanly picked on Slipper and not prosecuted other MPs.

MarilynS @5.40pm, under section 44(ii) of the Constitution, “a person who…has been convicted and is under sentence, or subject to be sentenced, for any offence punishable under the law of the Commonwealth or of a State by imprisonment for one year or longer..”
So to be disqualified you only have to be convicted of an offence which can carry a sentence of one year or longer, you don’t have to serve one year (or any prison time at all).
Of course, as happened with ex-Senator Fisher, a court would be most likely to record no conviction. There is no chance that Slipper would be disqualified.

How would a citizen go about bringing Abbott’s inappropriate travel claims to the attention of the AFP? I.e., how do you lodge a complaint to the federal police? Complaint needs to go straight to AFP to bypass Minchin protocol? Is it worth doing this, just to see what happens?
Maybe I’m being naive again, but the only way to get the message out to the populace is by way of twitter.
I have spent quite a bit of time of late engaging with people on twitter and feel that there is a ground swell developing especially about LOTO and the LNP.
How many of you here use twitter? If you do, how many of you actually forward IA’s great articles to followers. Not only IA’s articles but many of the other left wing bloggers who have really good articles and discussions.
If you are worried about using this form of getting the message out, you can find out who is who and what they stand for. I follow Margot, Truth Seeker, and many many more now. I even follow some of the more moderate right wing tweets, just to see what they really stand for although must admit I haven’t yet been game enough to engage in a conversation.
If we want the 5th estate to spread the message of truth then we can do so, person by person.
Am I being naive again (thanks for your comment by the way Sue? Most probably, but I am also an optomistic, determined old sod who just wants to see justice where it is true and truth no matter what.

One of their “friends” I noted was writing this hideous stuff about Julia Gillard. I thought I was writing only to my daughters when I wrote what I thought of these “friends”. Marilyn, both Anne and I get your message on refugees. This article is not about that subject, its about helping Vince & DD get a message out to the general public that is absolutely vital to democracy in this country.
As for those that want to know about Twitter. I started very cautiously and used the tweet icon only from those sites (like IA, Cafe Whispers and the Political Sword. Got a few responses and comments, checked them out. You can also check out when someone has forwarded your tweet.
Was using facebook but have stopped as I don’t like the trolls who try to stuff your computer up (they send you a tweet with a link to open) just don’t open it – delete the tweet completely.
I am fussy who I follow, you have to be careful and vigilant with all social media, but I’m learning (hopefully) that to use it wisely as it was meant to be used, we can make a difference when we are proactive, because it means that each and everyone of us can have our say about the way we want Australia to be governed.

OT: Refugees aren’t border protection. Refugees who come here on a boat aren’t trying to sneak in to Australia, they make themselves known at the first opportunity. Linking refugees and border protection was a wicked move – was John Howard the first to do it, or has it been going on for a lot longer? Now people think invasion when they think refugee!

I think you’ll find that Tone’s two daughters now work in London It was a good chance to visit them on the public purse just before Christmas. What a guy!
It always amazes me that Tony rides his bike for charity. It is a bit like asking the kids to eat lollies for charity. Tony’s first love is his bike and being on show, just like a showman. So when he rides his bike for charity and gets living away from home allowances for it, makes me sick and naturally only a handful of us will know.
Good luck to his daughters in London and I hope they can now enjoy their young years doing what Tony sometimes did!!
