When prominent Australian investigative journalist Margo Kingston heard Tony Abbott say the AWU slush fund issue was all about Julia Gillard’s character, she couldn’t have been more surprised.
A QUESTION of character?
My mouth fell open when I heard Abbott’s final flourish in Thursday’s speech denouncing Gillard as unfit for office. I remembered, suddenly, vividly, Tony Abbott’s very own slush fund. Could he too have forgotten?
It’s ancient history now, Abbott’s slush fund ― but less ancient than the slush fund now in the news. And there’s many unanswered questions about it, and him.
In 1998, Abbott privately agreed to bankroll Terry Sharples, a disaffected One Nation member, to take legal action against Pauline Hanson.
Less than 2 weeks later, he categorically denied to the ABC that he had done so, and 18 months later he repeated the lie, this time to the Sydney Morning Herald’s Deborah Snow. But when she
confronted him with his signed personal guarantee, he said that:
‘…misleading the ABC is not quite the same as misleading the Parliament as a political crime’.
He then created a slush fund he called Australians for Honest Politics and raised $100,000 for it from 12 people he declined to name. The fund began bankrolling more court actions against Hanson and her party.
And there it rested, his lies largely unknown to the public, until court proceedings by Sharples he’d helped kick-start finally resulted in her being jailed.
The overwhelming majority of Australians, like her or hate her, hated that, blamed Abbott for setting the legal wheels in motion, and wanted to know the details.
In a famous interview, Kerry O’Brien demolished Abbott’s facade of misunderstood nice and proved to a much bigger audience that he was a serial liar.
But there’s more!
The Sydney Morning Herald’s Mike Seccombe then reported that, in 1998, the Australian Electoral Commission asked Abbott to disclose his donors, as required by law.
He refused, telling the Commission that before seeking donations:
‘I spoke with one of Australia’s leading electoral lawyers who assured me that the trust would not be covered by disclosure provisions.’
The AEC took him at his word and closed the file until forced to reopen it in 2003.
Abbott had lied again!
When I asked him on September 2003 why he took legal advice on secrecy before soliciting for donations, he said:
‘I didn’t take legal advice on disclosure till after I got the AEC’s letter. I sought legal advice and got oral advice from a senior lawyer.’
In other words, he lied to the AEC.
Some would say that amounts to a criminal act under Section 137.1 of the Commonwealth Criminal Code (1992): the crime of providing materially false or misleading information in compliance with a law of the Commonwealth.
Me, I’d give him the benefit of the doubt.
Except that in a later written statement to me, Abbott revealed that his lawyers had not even been briefed with the Trust document before giving advice, and refused to even name the lawyer. Not only that, he told me he wouldn’t disclose the donors because
‘….there are some things the public has no particular right to know.’
Much later, the Electoral Commission decided that Abbott did have an obligation to disclose his donors. Unfortunately, by this time, they could not legally compel Abbott to do so, because the Statute of Limitations has expired. So they asked him nicely. But he refused.
So, there’s still unanswered questions ― and it’s a question of character, isn’t it. So let’s get this sorted?
There are questions of character over the PM and the alternative, both concerning slush funds.
She says she’s done nothing wrong ― apart from being used by her boyfriend.
He says she might be a criminal, no less.
Like many others, I haven’t followed this story in detail, so I listened hard to their speeches on Thursday.
I couldn‘t see anything really bad in his allegations; he didn’t show she was party to the Wilson fraud or had lied about her involvement. But, for me, she made the mistake of assuming her audience knew the detail. She needed to state simply what happened, hard though this must be, when her personal life is involved and, let’s be honest, she’s been made a fool of by a lover.
Too much lawyer talk, not enough human talk, I thought.
Still, I believe her. I believe she was sloppy, but innocent.
If that’s true, then she has two choices now that Abbott has accused her of being a criminal.
She could sue ― or, she could write to Abbott along the following lines.
I will call an inquiry into my involvement in and public statements about in the AWU slush fund ― if you will consent to the same inquiry examining your involvement in and public statements about the Australians for Honest Politics slush fund.
They are both very old. They are both about character. And how Tony Abbott might react would say a lot about his character.

By Thursday it was obvious that the Liberals were trying to get her to condemnn herself out of her own mouth. They were flourishing a piece of paper that may or may not have contained pertinent information that they failed to read into the Hansard record so the PM had no idea whether they had something from the illegally kept records of the former Slater & Gordon partner Nick Styant-Browne.
A slip of the tongue and they would have had a ‘gotcha’.
Interestingly, after his 15 minutes of fame at the end of question time Abbott tried to read the piece of paper into Hansard but the Speaker wouldn’t let him.

The problem for her is whatever she says or does even from 17 years ago, is subject to a level of bile & hatred that distorts any fair picture & makes her the victim of a concerted sustained bullying campaign from just about every direction.

When I saw the type of people in the Opposition on Thursday, I thought, God will have to help us all if they got power.
I am simply amazed at the strength of our PM. I certainly couldn’t have kept it up every day for 2 years. There would be

The issue that they have tried to get across are a complex set of Legal procedures, which the liberals have apparently spent much of their time misrepresenting. It is a measure of the incompetence of Julie Bishop as a solicitor that she has not been able to land a legal blow.
It is also a measure of Abbott and his trepidation and the tremulous waver in his voice that true bullies when they are confronted, like he was yesterday, are shown up to be the true cowards they are.

Today I had the misfortune to watch abbort giving a press conference in which the demands he was making became more and more outrageous every time he opened his mouth. The media had an opportunity to ask a very important question: If the PM agrees to your demands and is found to be innocent of all your accusations will you immediately resign?

The issue has not been raised by the press gallery because it hasn’t got a head of steam. The AWU one has, so they go with that. In my time only a few gallery people were prepared to do their own thing, and my guess is that hasn’t changed, except that there are fewer journalists now, given the cuts, so there’s even more pressure to conform.
My guess as to why Labor hasn’t raised it is that if they did it would like like they were saying you’re as bad as we are. Abbott has crossed a very big line here – he’s prepared to call her a criminal without evidence, then demand she hold an inquiry in case there is any. She must defend her integrity tenaciously, and throwing back dirt makes her case weaker. It is up to the media – old and social – to raise this and pursue it until he has to answer the unanswered questions. Just as Hedley Thomas and co. would say they have done to Gillard.
I left journalism because the Sydney Morning Herald would not support Webdiary in a phase of its rapid expansion, and I was overwhelmed with work. You would have to ask them why they withdrew their support. It was a stupid decision, logically. I went independent with help from Webdiarists to try to save the site, but my back (and bank balance) went and I had to retire. Since then, I’ve seen it (over time) as a hidden blessing, because now that I’m not a workaholic I’ve started learning about the real pleasures of life.
I’ve been an internet refugee for many years, and today I’ve learnt the basics about twitter and can understand how people get lost in it. Fascinating!.
Re the mainstream media, its been corroding for years and years. i didn’t see it clearly because i had the honour of writing for and editing Webdiary, thus genuinely collaborating with and publishing the work of readers.I felt the SMH should bring the readers in to our space, and that this would preserve the old business as well as embracing the new one. I didn’t see Webdiary as ‘a blog’ but as part of the paper. My approach was right, as it turned out, but even by the time I retired, in 2005, my colleagues thought I’d marginalised myself online.

I thought he did well with what he had, which was not much. He has to seem reasonable, because he is being truly outrageous. She was angry and flustered because he wins even as he loses, and she loses even as she wins – due to the mud sticks principle. This is just about the most horrible, ethically corrupt opposition tactic I’ve ever seen. Which is why I feel that she needs to do something radical to bring him to account. Like sue, or make him an offer he can’t refuse which could nail him to the wall and set her free. It’s not as though the media is doing its job, is it? And she’s facing enemies within as well as a rampant opposition. Gotta admire her guts. Got to.

I googled and read some of your SMH articles earlier this evening and am mightily impressed with your courage. this is an ingredient which is sadly missing from the MSM nowadays.
The classic example is the absolute cover up of the truth in the Thomson affair. The slipper affair is also a crock.
Gladly Independent Australia has filled a huge void and told us the truth of the matters which have been misreported to the general public. There are other similar courageous online Journals which provide us with the truth.

If there was an allegation of misuse of funds then I would.agree that there is a story here but there is not, unlike the AWU fund.
As for comments complaining that the ABC has been high jacked by the right – how many conservative commentators can you name on the ABC, half? Half would be balance.
Wrong on both counts.
The fact Abbott may have committed a crime in not declaring donors to the AEC is very serious, obviously, misuse of funds or not.
The ABC easily outnumbers leftwing commentators with those from the right by its slavish use of IPA stooges, formers Lib politicians like Reith and far right hacks from News Ltd.

Hi aleem. Abbott does not claim Gillard misused funds, but that she helped set up an organisation which was then used by others to misuse its funds.
The point here is that Abbott’s claim that she is a criminal is based on her allegedly misleading the WA Corporate affairs body. He is alleged to have committed a criminal act by misleading the AEC. There is more evidence that he’s a crim than that she is.

Thanks for this and for your many other articles. It’s a sad reflection on current journalism that articles using primary sources are refreshing. That’s a lesson Tony Abbott hasn’t learned, to his constant cost.
i agree that it’s best left to the media rather than the PM or Labor, as even then it’s impossible to convince some that it goes to looking at the shakiness and hypocrisy of TA’s ‘moral high ground’ rather than just muckraking as they’re accused of.
I do find it strange that someone thinks having someone jailed and deliberately destroying a rival is less serious than fraud of a companies’ money, especially when the companies said they weren’t defrauded.
The Slipper/Ashby case, Thomson/Jackson/Williamson and the Mal Brough ‘pedophilia rings’ stories would also all make interesting investigations for Party/other parties involvement.
The reason Mr Abbott said she could have been involved in a crimminal act is those words would be televised written about,spoken about in the media which is either owned by Murdoch or are is in his piosionous pocket and that all the people that have been dumb down by them will follow like Lemmings

This reminds us once again of the decline of the mainstream Media as purveyors of the truth.
Whilst Australia slept Quality journalism has disappeared from the likes of News LTD and been replaced by Partisan Right wing crap.
One only has to look at the likes of Nikki Savva, Piers Akerman and Gerard Henderson to see that my assertion is correct. The sadest thing about this is that we are a society where lies are believed above truth.
This Journal has busted many myths about the reality of what is going on.
The Jacksonville saga is compelling in its forensic look into the truth about the payment of money to prostitutes. Kate McKlymont from the SMH who “broke” the story will now not admit that there is sufficient reasonable doubt as to her evidence against Thomson. Two stark facts emerged thanks to IA and Peter Wicks. The credit card code shows that the credit card mis spelled his name with a P added and the slip had a rejection code on it as well.
The Walkley committee nominated her for this story. She was a finalist for another story about the Obeid family and was awarded with the Walkley for that story.
It is embarrassing that the awards for journalism have reached the depths that they have. To be nominated for an award for journalism which has been largely refuted is breathtaking.
The collective Media should hang their heads in shame for the complete lack of coverage of the truth of this matter. It is as if a huge cone of silence has descended across the country.
Leveson in the UK has uncovered the sort of depths international journalism has descended into. Mills and Boon have nothing on them or some of the people in Australia.
The Tony Abbott business with Pauline Hanson is the tip of the Iceberg. Howard’s Government have many skeletons in many closets and they are straining to get out.

It seems to me that there is a clear difference between Gillards actions re the AWU affair and Abbotts Slush Fund. As a lawyer she was acting on the instructions from a client … a lawyer who acts under instruction is not guilty of a crime they are merely representing their client (although in Gillards case probably poor judgement to represent her then boyriend). Abbott it appears broke the law in relation to AEC declarations.
It fasinates me that I have not seen one comment to defend Gillard from MSM which acknowledges she was acting under instruction!
We have a US base in Darwin being enlarged, a new Disability scheme, a carbon price (is it working?),a comprehensive report on education by a man who is no lefty..but we know very little of these if we read our media or watch TV. Not even the ABC brings us details of these very important policies.
All we have is this mind numbing stuff about lawyers letters from 20 years ago. I despair. Even in the USA & GB with Murdoch and Fox News dominating they still have credible news outlets that examine government policy.
What is wrong with the journalists in our media?. I cannot believe the vast general public gives two hoots about this HSU stuff. What I can see is that the Opposition with the aid of the MSM have actually given Julia Gillard the opportunity to shine under adversity. I’m not sure that was the intention.

The Abbott is a blight on our national political discourse and thanks for the reminder of such. In no way is the man fit to lead Australia as a PM.
That the MSM presents him as a viable alternative is obscene.
At least MG raised this issue a little bit, do they really think we all have short term memory loss.
I agree the PM could’ve been more forthright but no doubt her advisers were advising on which way to respond. The mere fact hardly any of the opposition turned upto the chamber on the last morning of sitting should be enough to tell the electorate what they really think of us.
yet to see anywhere who the 6 that turned up were. Kudos to them must look at the Hansard to see if they are listed.
Abbott is a dead duck and the constant demolition of parliamentary process proves it.
We deserve a working and proactive parliament, not an obstructive opposition for the sake of it.

That crap is not the sole topic of our parliament, just the media reports.
I have been scraping paint (renovating), listening ( rather more carefully than usual) to parliament on the radio. My conclusion is that at present, Parliament is like the Bodyline series.
One group of parliamentarians are talking policy, announcing new policy, passing bills, asking Dorothy Dixers for updates on policy and implementation.
The other group of parliamentarians complain all the time, never find anything good in legislation before the house, and often go of topic to include that day’s three word slogan.
You can tell whether a speaker is coalition or not within the first sentence.
During the week in which the media reported on the AWU rubbish (to which admittedly, the opposition had devoted every question), the government has done solid achievements:
Released the Murray Darling plan
Introduced the bill to create the NDIS trial
Debated number of bills raising revenue (with which the opposition disagreed, but offered not constructive legislative solutions (like amendments).
There are two teams in our parliament, but only one o them is playing the game.
The best bit was when Gillard gave Abbot 15 minutes to put up or apologise. He was incredulous that he had anything to apologise for, having that morning accused the PM of criminal acts. She knew the report on which he had relied had been retracted, but he did not. Mentally watching him flail around for 15 minutes, accusing her of lesser and lesser misdemeanours, ending with ‘conduct unbecoming’ was amusing a bit pitiful, but not at all convincing. Then Gilliard stood up and ripped him to shreds, pointed out that the report had been retracted, and that Abbot had been unaware of that fact, that he was sloppy.

Congratulations Margot for raising this issue again in such a detailed and forthright manner. I saw one question asked of him re the slush fund at a “presser” before he got on the truck. He brushed it off with a brief reply something to the effect that his actions through this fund were trying to maintain the law while the PM’s actions as a lawyer were trying to break or circumvent the law. Not actual words but I believe to that effect. I will be borrowing “Not Happy John” from local library in Dubbo where I live for more background. This story must not be allowed to die just because MSM is controlled by conservatives. And as for your article not hitting The Drum with Mark Scott at the helm of the ABC and his obviously conservative leaning past it is no wonder. Well done and keep it up. I believe it was one question.(ABC24 not certain).along the lines of..What do you think of reports regarding what he setup and the slush fund..Ans was I setup something to stop criminal activety whereas PM setup something that enable criminal activety – Not gospel but, along those lines.
