More documents from the HSU have surfaced, raising new and very serious questions about the financial probity of Kathy Jackson’s administration. Peter Wicks continues his investigation.
Daily, it seems, we receive more information on Kathy Jackson’s activities in her role as Secretary of the HSU. Much of this information leads us to ask serious questions.
Once again, I must stress that in no way am I saying that Jackson is guilty of anything. I am, however, looking forward to hearing her explanations for the transactions we have shown previously, and the ones we will expose in this article.

Before I do that, I need to answer a pertinent question myself; some have asked if the documentation that has come into my possession has been shown to the relevant authorities.
I can confirm that Victorian Police have copies of all documents shown in our articles, as well as all other documentation — and, further, I am also passing the documents on to Strikeforce Carnarvon in NSW. Both have active investigations in progress on these matters and more will come to light over the coming weeks.
In the meantime, Peter Mylan, the Acting General Secretary of HSU East, has been trying to clean up the accounts. Part of this job involves investigating the expenses that remain unexplained from when Kathy Jackson was controlling the expenditure.
Indeed, we have several documents, including receipts, and letters from Mylan seeking explanation for mysterious transactions. At the time of writing this, it is my understanding that none of these have yet been answered.

Let’s start with the Jackson’s Volvo. The receipts show that the balance outstanding on the vehicle was $41,285 after the trade-in — however the payment from the HSU was for $46,290. As you can see from the letter from Mylan, the HSU is querying the extra $5,005. We understand no answer has been received from Silverstone Volvo as yet.
More consultancy companies were paid with no clue as to what service they had provided. As you can see from the letters shown here in the links, Ms Sue Loukomitis was paid $2,750 and Numbat Consulting was paid a whopping $134,524.75. For what? Nobody can yet figure that out.
Jackson’s close friend and co-worker Ruth Kershaw, who went on overseas trips with Jackson, was also the recipient of some consultancy fees. Kershaw’s appropriately named company, Governing Ethics, was paid $28,700 — again, for services that are unclear, at best.
It’s not just consultancy either — it also legal services. Wai Quen, who used to work with Jackson, was paid $22,000 for “legal services” — in Hong Kong, of all places. Why did she need legal services in Hong Kong? We don’t know and Jackson’s friend and co-worker is yet to respond to Mylan’s request for answers.
Being a friend of Jackson’s, it seems, may be good for business. It would appear you don’t even need to do anything to get big payments, except of course provide your bank account details.
Even ex-husbands get a look-in. Jeff Jackson, for instance, received $58,000 into his personal bank account as a “Loan to Vic No.1 Branch”.
Not only did this money not get transferred to HSU No.1 branch directly, but Jeff Jackson had not worked at the branch for a year — so why would they send the money direct to him? It seems odd in the extreme.
To Jackson’s credit, though, it was not all strange fund transfers while she controlled the purse strings — she also did her bit to help out the younger generation by showing youngsters how to earn an honest day’s pay.
Looking at the attached pay slips for the following two kids, both apparently attending school at the time, it is clear she liked to help out the young.
These children earned $24.14 and $21 an hour. More than many of the low paid HSU Members earn even now, as adults. But then again, these kids worked for the branch in Victoria — but lived in Sydney, so I guess their travel expenses might have been pretty high.
So, why would Jackson employ these kids and pay them so much?
Could it be because their names are Matthew and Donald Lawler?

That’s right, these two are allegedly the sons of Jackson’s partner Michael Lawler — who is, of course, the Vice President of Fair Work Australia.
So when Michael Lawler’s organisation, Fair Work Australia, was investigating the HSU, many rightly thought it was a conflict of interest that his partner Jackson was the secretary of the union. Now it appears as if his two sons were also ex-employee’s — or at least on the payroll.
It defies belief that nobody ever had a light-bulb moment and thought: “Ah … this may be a conflict of interest.”
Iain Ross stated in a senate committee that because Lawler is a sworn judicial officer and had taken an oath, he would not investigate complaints of bias or conflicts of interest.
Given many people take oaths and are still investigated, this would appear to be a preposterous excuse. Police officers take an oath, but yet we have an entire department set up to investigate them. Politicians take an oath, including Craig Thomson — and the FWA spent five long years investigating him.
I recall an investigation into a judge in Sydney over a speeding ticket. You may remember, Marcus Einfeld, a man who Iain Ross would probably class as beyond reproach, given his opinion on Lawler’s accountability. After all, Einfeld took an oath and was a judge. However, he was caught speeding by a camera, and then tried to say it wasn’t him — that it was, apparently, a woman driving, Unfortunately for Marcus, the woman he named was dead at the time of the offence…
I think this matter warrants more attention than a speeding ticket.
Iain Ross, the President of Fair Work Australia, interviewed by Leigh Sales on 7.30, refused to stand by the Investigation into the HSU, repeatedly.
Alarm bells anyone?
Currently, Jackson is in Federal Court, fighting against the wishes of the membership, the National Branch, HSU East, and the Government, to demerge the branches and to appoint an administrator to clean this whole sordid mess up once and for all. Once an administrator is in place, forensic audits are likely to be done on the Union’s finances, including the approximately 400 boxes of sealed evidence from a previous Victorian Police Investigation, which have now been reopened.
Once again, one wonders what Jackson has to hide.
Still, it’s not all bad for Kathy Jackson — shock jock Alan Jones, a man Tony Abbott proudly calls a “mate”, is rumoured to be holding a fundraiser to help Jackson raise $40,000 for her legal bill.
Hmmm…

There were allegations on VEXNEWS some time ago that JJ had pay transferred into KJ’s account to avoid maintenance payments to his and his former partner’s children…so perhaps it’s money that KJ owed him

Peter, you might find that a consultant was used in determining Jackson’s massive HSU salary. You might also find some connection between the consultant and the happy recipient of the consultant’s advice. Happy hunting and keep up the good work.
The “investigative” hack fronting ACA thundered that the sex worker they were interviewing had signed a statutory declaration as to her supposed meeting with Thomson and gave the impression that it confirmed her story. Another fizzler.
So who has the HSU’s Volvo?. Kathy Jackson denied driving it when she was interviewed on the 7.30Pm report.
A Victorian HSU member brought charges against Jackson dealing with the sort of allegations disclosed by Peter Wicks. The HSUeast council would have dealt with these charges. However in the meantime Jackson went to the court (with her pro bono lawyers) and in a transparently self serving move argued that the NSW counsellors should not be allowed to vote which if upheld would have made her immune from censure by a council she hoped would then be dominated by her supporters. Subsequent court applications have stalled her tactics but in any event the court said it would disapprove of any council meetings being held while court proceedings took place which has kept the hearing of the allegations at bay.
Also going on in the courts is an application to appoint an administrator, stand down the executive and demerge the Victorian and NSW branches. All the executive are in any event prepared to stand down with the exception of Jackson and Bolano. Jackson has an application to the court which as usual is breathtakingly self serving. She argues she should not be required to stand down because – wait for it – she has done nothing wrong!
She also opposes the demerger. This despite a motion carried by a two thirds majority of the HSUeast annual convention that a demerger occur – a resounding rejection of her and her destructive actions.
Both these applications are designed to protect her and her alone from the natural consequences of her media sponsored grenade throwing.
It’s one thing for an agenda-driven media to let her get away with all this, but if the courts do the same, you have to wonder where ordinary HSU members can turn to find justice.

Just around the time that ACA hooker interview had fallen flat, but more likely because Michael Lawler’s involvement in this affair was becoming too apparent, the media dropped the Craig Thomson case like a hot potato.
A few days ago on the Drum on ABC24, Steve Kinnane asked Imre Saluszinsky – actually it was more like a suggestion – whether the public had lost interest in Craig Thomson. Saluszinsky of course said yes. I saw this as the latest right-wing meme being developed, almost as a message directed at the rest of the media, to lay off Thomson because it was starting to backfire on Tony Abbott. Indeed I think this is what Thomson and Albanese may themselves have recognized, and they saw the benefit of keeping the whole issue alive in the media. Thomson’s crossing the floor to join with the Libs was an act of political genius which I don’t think has been given sufficient credit in the media.
The liberals and their cheer squad never factor in the revulsion of the ordinary punters like us when they continue to persecute the same person over and over about nothing much.
And did the Lawler kids get the job of sifting files to take out anything incriminating Jackson.
Like the ones sent to Peter maybe.
I wonder if the Lawler kids actually left NSW for employment in Jackson’s Victoria office or it’s another of her double dipping ie pocketing HESTA directorship fees then billing HSU for attending HESTA meetings.
Lawler $400K was more than Tony Abbott’s and on par with the PM Gillard. Jackson 3Y teacher diploma plus 13wks Harvard summer school can in no way justify her ridiculous salary which she herself admits is exorbitant and more than Paul Howes’.
No Civil Servants other than very few senior government ministers can ever justify the sort of ridiculous remuneration packages HSU and FWA been paying their Administrators, when the majority of HSU union members barely take home 40K, no matter what any Remuneration Tribunal says.
The Private sector’s large salary packages are usually performance based. In my opinion even Rheinart, Forrester, Palmer et al should have their salaries capped. Off with their heads!

Chris ran a packet of questions together, to which her first response was a kind of ‘pffah’ cum head toss/ eye roll, and then she zeroed in on the part of the question she could, presumably accurately, deny – bieng the moment at which her salary doubled.
Chris never got back to the questions about the car and childcare.

Wow !! These articles are an interesting read. Obviously more questions than answers popping up at the moment. It has been acknowledged that the intention of these articles is not to exonerate CT from accusations by the kangaroo court. However, I defy any member of public (with average IQ) to not raise an eyebrow and question their own thinking after reading. I note that the member for Dobell has tweeted a link to these articles. Am I naive to wonder why he is not more heartily shouting from the roof tops about these articles? Are there political cards to be played out here? I agree K.Jackson has lost it but why won’t they lock her up. A spell in the big house would do her a world of good. Trying to contact the Judge hearing her case is tantamount to corruption of a public official and is a serious offense, not to be taken lightly nor is it the action of an innocent person

This has taken 20 days to even come to the attention of the Mainstream media (The Australian).

Given that this scandal has been used by the conservatives to try and topple the sitting government, one would imagine that they would be interested as the one who made the complaint about Thomson was Kathy Jackson. Discredit her and the whole thing is discredited, Abbott, Pyne, Brandis and Abetz are shown up for what they are, Power hungry.
I am disgusted in the ABC and have come to the conclusion that they are biased. no other explanation of their non interest in Kathy Jackson and the revelations by IA can be explained any other way.
IA haven’t been sued or threatened to be. If they were writing rubbish they would soon be in front of a judge.

One fails to see what Jackson’s real reason is in objecting to the Minister seeking to wind up the dysfunctional HSU offices that has for years been gripped by infighting and corruption.
Considering Miss Jackson is already half way through the door with her long overdue dismissal where she should have been swiftly drummed out of the Union and out of the Party for bringing it into such disrepute. As long as the proceedings drags on Jackson will continue receiving her exorbitant salary ie more money for nothing.
Justice Flick however has made it clear, he will not countenance any dilatory behavior in his Court despite giving Jackson and her Solicitor additional time for today’s tet a tet.
In the link, given by Lydia, above, at 2.30pm, the story in The Australian titled – “Kathy Jackson faces action after allegedly attempting to contact judge outside court” – states that Bill Shorten has made an application in the Federal Court to “have an administrator appointed to run the union because of what he has described as a ‘dysfunctional’ leadership”.
Also, The Australian reports that “the application is generally supported by the NSW government HSU East acting general secretary Peter Mylan, HSU acting national president Chris Brown, and most state branches of the union, Ms Jackson is opposed to aspects of it including a proposal to split the union into the Victorian and NSW branches which merged two years ago”.
When Kathy Jackson was interviewed by Chris Uhlmann, her answer was the following in relation to her wage increase:
“I can tell you my wage increase happened when we amalgamated, when we became part of HSU East. That’s when I got a wage increase…I did not… when I became National Secretary I went on a wage that he [Craig Thomson] was on. The increase I received was post amalgamation….At mediation last week in the courts, as part of that mediation process I put my hand up and said that I should get at least $100,000 salary cut and that was rejected.”
If the proposal to split the union is successful does that mean Kathy Jackson will return to the wage she received prior to the amalgamation and therefore lose $100,000 and if this is so then her opposition to split the union, obviously, has absolutely no connection to this potential salary loss for she admitted the $100,000 was excessive and actually begged that it be taken away from her – a most impressive altruism. I wonder if it is limited only to the Australian dollar.
I work for Anglicare Tasmania in their shared homes program for $18.24/hour. But I guess I don’t have the skills of young Matthew Lawler.

No I don’t think you are naive. Only Mr Thomson or his legal team can probably tell us why. These are my possible suggestions.
A. He really did go around with a card made out to Craig ThomPson, and doesn’t wish to have this further investigated by the media. Remember, all Mr Thomson had to do was mention this in one of his many statements and the media would report it.
B. He didn’t go around with a card made out to Craig ThomPson
B.1 He is in a situation where people are falsifying material and doesn’t want to draw attention that he knows this, less they falsify even more material.
B.2 He wants the prostitute allegations to go ahead with all the other allegations that perhaps his defence is less secure or more based around matters of he said/she said. By having these other matters heard at the same time as obvious malicious claims will help to discredit them and be to his advantage.
B.3 He is keeping silent solely on the basis of legal advice, legal advice whose independence is compromised due to the fact that until recently it was being funded by NSW ALP. Remember these allegations arose in 2009 and somehow CT managed to win his seat in 2010 with neither the Sydney Morning Herald or the Coalition constantly drawing attention to the fact he is supposed to have used union funds in brothels. Had it not been for the hung parliament all this might have slipped into quiet oblivion.
It seems to me if he wasn’t using a Craig ThomPson credit card, then even the most incompetent legal team would be able to clear him in the situation of a court proceedings, simply by applying for the records of the financial institution. If I understand the situation correctly, the customer keeps one slip, the vendor another slip and the original slip goes to the institution (correction on this point welcome). If someone else was using a Craig ThomPson card, there should be two sets of slips in the records (as it appears to be the case these records are kept, or at least if they have a “invalid verification number” 211 code written on them…..). However, his rights to these records is less clear if there is no legal proceedings (perhaps under Privacy legislation?).
Hence everyone, except CT, had an incentive to try and avoid this coming to court. The Union, because it would expose the corrupt nature of Union politics and administration. The Union officials, because they would be guilty of identity and document crimes and filching money. The Labour Party, because it will probably shine a light on corrupt interplay between factions and unions – and I am more than willing to bet that there have been Labour party faction heavies playing a double game in advising CT very badly (Graham R.). Fairfax and News Ltd, because they will have possible libel liabilities and may be guilty of passing falsified documents to the court (Fairfax) when they may have suspected they were not genuine [I think the discovery process that Fairfax undertook against CT suggests they had their doubts all along]. The Coalition, because it would undermine their attempts to force a resignation.
And of course, Fair Work Australia, who have the interests of Michael Lawler to protect. Have they actually pressed charges yet, or are they still dilly-dallying?
These are my suggestions, all of which may be wrong.
higgs boson@9.30 Note your take on it. I can see where Jackson would be having kittens at the thought that the de-merger could expose her culpability in the fraud inside the HSU. However losing the extra $100K, she had gifted herself, would hardly seem likely to stir a hair on her head. After all, if you believe her version of events, she hadn’t wanted the extra $$$ in the first place, and had to be forced into accepting it.
Surely still not enough reason for her to behave like a Galah in the manner in which she and her cohorts were so determined to dig a hole for Thomson.
It’s obvious to me that, all by her lonesome she couldn’t hit the floor if she fell on it, so someone had to be pulling her strings. I think she should have stepped back and allowed Lawler to do his own explaining, instead of behaving like the proverbial Turkey praying for Thanksgiving.
There is clearly a lot more to this story than we have heard from the Coalition/media.
Not surprising that the ABC ignores it. They are every bit into regime change as News Limited and Fairfax.
There needs to be a full-scale investigation, into not only this story, but the politicisation of the ABC also.

And so it comes to pass : the sex worker now on Today Tonight apologising to Craig Thomson as she realises she was in new Zealand at the time after looking at her passport.
Watch the MSM now pick apart the whole matter despite IE doing much ground work.
